Welcome to Forgemaster AI! These Terms of Service ("Terms") govern your access to and use of the Forgemaster AI services, including any software, mobile application, or website provided by Forgemaster AI (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
1. Acceptance of Terms
By using the Service, you affirm that you are of legal age to enter into these Terms, or, if you are using the Service on behalf of an organization, you affirm that you have the authority to bind that organization to these Terms.
2. Changes to the Terms
We may update these Terms from time to time. If we make changes, we will notify you by revising the "Last Updated" date above and, in some cases, provide additional notice (such as adding a statement to our website or sending you a notification). Your continued use of the Service after any changes will mean you accept the revised Terms.
3. Description of Service
Forgemaster AI is a software-as-a-service (SaaS) platform designed to enhance documentation and knowledge management. The Service allows users to access AI-powered tools and functionalities, including automated documentation generation based on source code and chat with AI agents. We reserve the right to modify or discontinue the Service (or any part of it) with or without notice at any time.
4. Account Registration
To access certain features of the Service, you may need to register for an account. When registering, you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account.
5. Subscription and Fees
Some parts of the Service may require payment of fees. If you choose to subscribe to a paid plan, you agree to the pricing, payment terms, and applicable fees as outlined at the time of your subscription. Fees may be subject to change with notice, and subscriptions may automatically renew unless you cancel before the renewal date.
6. License to Use the Service
Subject to these Terms, Forgemaster AI grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your internal business purposes only. You agree not to:
- Reverse engineer, decompile, or disassemble the software.
- Use the Service in violation of any applicable laws or regulations.
- Share or distribute the Service or any component thereof to third parties without prior consent.
7. Intellectual Property
All rights, title, and interest in and to the Service, including all intellectual property rights, are and will remain the exclusive property of Forgemaster AI and its licensors. Forgemaster AI's name, logo, and related marks are trademarks of Forgemaster AI. These Terms do not grant you any rights to use any trademarks, logos, or other brand features without prior written permission.
8. User Content
You retain ownership of any content you upload, post, or submit through the Service ("User Content"). By providing User Content to the Service, you grant Forgemaster AI a worldwide, royalty-free, non-exclusive, sublicensable license to use, store, display, reproduce, modify, and distribute your User Content solely for the purposes of operating and improving the Service.
You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish and submit the User Content you provide. You agree that you will not submit any User Content that is copyrighted, protected by trade secret, or otherwise subject to third-party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner.
Forgemaster AI does not endorse any User Content submitted to the Service and expressly disclaims any and all liability in connection with User Content. Forgemaster AI reserves the right to remove User Content without prior notice if it infringes on another's intellectual property rights. Repeated infringement may result in the termination of your account.
9. Privacy
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you consent to the collection and use of your information as outlined in the Privacy Policy.
10. Termination
We may terminate or suspend your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, Forgemaster AI, or third parties.
You may terminate your account at any time by ceasing to use the Service and/or notifying us. Upon termination, your right to use the Service will immediately cease.
11. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that any defects will be corrected.
12. Limitation of Liability
To the fullest extent permitted by law, Forgemaster AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the service; (ii) any conduct or content of any third party on the service; or (iii) unauthorized access, use, or alteration of your content or account.
13. Indemnification
You agree to indemnify and hold harmless Forgemaster AI, its affiliates, officers, agents, and employees from any claim, suit, or action arising from your use of the Service, violation of these Terms, or violation of any third-party rights.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the Estonian Arbitration Court, unless both parties agree to another form of dispute resolution.
15. General Provisions
These Terms and our Privacy Policy constitute the entire agreement between you and Forgemaster AI concerning your use of the Service.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.
You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without restriction.
